The Division of Water Pollution Control develops and implements programs to prevent or clean up the pollution of surface and ground water in Massachusetts. The division, in accordance with the federal Water Pollution Control Act (PL 92-500, 402, as amended) and MGLA c 21, ss 27 and 43, joins with the federal Environmental Protection Agency (EPA) in the National Pollutant Discharge Elimination System (NPDES) program to create surface water permit files, which authorize and control discharge of pollutants into surface waters. Files may contain fact sheets; draft and final permits; correspondence concerning revisions to permit provisions, seasonal discontinuance of disinfection, and violations of permit requirements; occasional discharge monitoring report forms; copies of environmental notification forms; and copies of operation and maintenance inspection reports. Fact sheets describe principal facts and significant factual, legal, methodological, and policy questions considered in preparing permit, and include information about the facility, owner, consulting engineer, and other permits to which the applicant is subject. Permits include such information as applicant name, address, location of plant, receiving waters, effluent limitations, monitoring requirements, maps and drawings of site, effective date of permit, date of expiration, and signatures of EPA and division representatives. Discharge monitoring report forms describe volume and characteristics of the effluent discharged by the permit holder on a daily basis.
